Good Funds Lending, LLC (“we”, “us”, “our”) uses text messaging as a communication tool in accordance with applicable laws of the United States and the State of Colorado. This policy outlines our practices regarding text messaging.

1. Scope of Text Messaging
We primarily use text messaging for the following purposes:
- Providing passwords or passcodes for encrypted documents;
- Provide answers to questions or information requests;
- Confirming meeting times, locations, or other information provided to us;
- Requesting details from borrowers, potential borrowers, title companies, or others related to investment and commercial loans or originating such loans;
- Confirmations; and
- Messages of gratitude.
We do not provide loan offers through text messaging. Good Funds Lending, LLC does not provide any binding offers or agreements through text messages.
2. No Consumer Loans or Marketing
Good Funds Lending, LLC does not make consumer loans. We make loans for business and investment purposes only. Such loans are secured by investment residential and commercial real estate (not owner-occupied residential real estate). We do not use text messaging to market to consumers.
3. Opt-in/No Unsolicited Marketing
Unless there is an accidental text, we do not send text messages to any person without consent. It is possible that when sending a text, we mistakenly enter the wrong phone number or have an incorrect phone number (each of these situations is referred to as an “accidental text”).
Explicit consent: We will not text you unless we have explicit consent, receive an explicit verbal request for a text message during a call from the same phone number, receive a text message from you, or have a pre-existing relationship with you.
Consent could be any of the following:
- Express consent for text messaging by submitting a loan application
- Express consent for text messaging by submitting a form on our website
- Express consent for text messaging by executing a written agreement with us or have been provided a loan
- Opted-in to text messaging by taking actions to trigger communication such as a button press, alert setup, appointments, is a party, vendor, or service provider in a planned transaction (e.g., loan closing/origination), request a text message verbally, or asks a question by sending us a text message
- Opted-in to text messaging by being a person with a prior relationship that has provided their phone number, has taken some action to trigger the potential communication, and has not expressed a preference not to receive messages
4. Frequency of Messages and Ongoing Consent
Except if a person is involved with a pending loan inquiry, existing loan, loan awaiting origination, ongoing conversation, or request for information by text message, we do not expect to text that person who has consented more than 4 times per year.
Occasionally, after consent (see above) we will reconfirm consent if sending a text message that is not part of ongoing conversations or is not triggered by a person’s actions. This reconfirmation of consent is done by providing instructions on how to stop receiving text messages (i.e., Opt-out).
5. Data Privacy & Database
We do not share or sell mobile data for marketing purposes. For more information, please see our Privacy Policy.
6. Opt-Out/Stop Receiving Messages
If you wish to stop receiving text messages from us, reply “STOP” to any of our text messages.
7. Text and Data Rates
Please note that standard text message and data rates may apply, depending on your agreement with your phone/text message service provider.
8. Introductory Message Information
Starting June 1, 2024, unless there is an accidental text, we may send the following details (or something similar or portion thereof) with our initial text message to a person with whom we have only had contact verbal contact (i.e., the person has not completed an application, not submitted a form on our website, or not otherwise executed a written agreement, and has not had any previous correspondence by email or text message):

Text message and data rates may apply.
We send text messages to respond to requests, provide passwords, confirm details, request information, and express gratitude. We have no plans to use text messages for marketing.
